THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.10367 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioners/A.2 and A.4 in C.C.No.13 of 2015 on the file of the Judicial Magistrate of First Class, Nandyal, Kurnool District.

When the matter is taken up for hearing, the learned counsel for the petitioners seeks permission of this Court to permit the petitioners to withdraw the criminal petition. He further submitted that the presence of the petitioners may be dispensed with before the trial Court on each and every date of adjournment. He also submitted that the trial Court has already framed the charges.

There is no dispute with regard to the identity of the petitioners.

Having regard to the facts and circumstances of the case, this Court is inclined to dispense with the presence of the petitioners, who are A.2 and A.4 in C.C.No.13 of 2015 on the file of the Judicial Magistrate of First Class, Nandyal, Kurnool District, on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence is so required.

With the above observation, the Criminal Petition is dismissed as withdrawn.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
