THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.2109 OF 2016 ORDER:

This Contempt Case is filed alleging non-implementation of the order passed by this Court dated 09.10.2015 in W.P.M.P.No.43022 of 2015 in W.P.No.33351 of 2015.

This Court passed order on 09.10.2015 restraining the fourth respondent therein from interfering with the possession of the petitioners' lands in respect of Survey Nos.73, 74, 180/78, 153/1, 180, 180/144, 153, 180/117 , 180/76 and 180/2, situated at Gouraram Village, Dharpally Mandal, Nizamabad District, without following the due process of law.

Now, a counter-affidavit is filed stating that the fourth respondent is not interfering with the said lands, but, however, he stated that the lands in Survey Nos.153 and 180 are included in Gowraram Extension-I, Forest Block in the year 1976 and they are in the custody of Forest Department.

In view of the averment made in the counter-affidavit filed in the instant case, the contempt proceedings need not be proceeded more so when the main writ petition is pending.

Accordingly, the Contempt Case is closed. Miscellaneous petitions, if any, pending in this contempt case shall stand closed. There shall be no order as to costs.
