HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35633 of 2016 ORDER:
This writ petition is filed seeking to declare the action of respondents 2 & 3 in registering the complaint against the petitioners in Crime No.148 of 2016, dated 03.10.2016, on the file of Kakinada III Town Police Station, East Godavari District, as illegal and arbitrary.
Heard and perused the material available on record. The main grievance of the petitioners is that the 4th respondent lodged a complaint before the 3rd respondent on 03.10.2016 which was registered as FIR No.148 of 2016 and that some disputes are pending between the petitioners and the 4th respondent and the present complaint is lodged with a view to scuttle the civil proceedings pending before the competent Court of law and that the 4th respondent has already lodged a complaint in FIR No.47 of 2016, dated 24.04.2016, for the offence under Section 498-A read with 34 IPC and Sections 3 & 4 of the Dowry Prohibition Act and the present complaint is filed to avoid the civil proceedings.
Considering the grievance of the petitioners, respondents 2 & 3 are directed to complete the investigation in Crime No.148 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, within a period of six (6) months from today without arresting the petitioners. The petitioners are directed to appear before the 3rd respondent as and when required for the purpose of investigation.
Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 17th October, 2016 KL
