HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 23027 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings dated 04.09.2003 issued by the 2nd respondent rejecting the claim of the petitioner for appointment of her son as Shramik/Cleaner or any other suitable post under Bread Winner Scheme, as illegal and arbitrary.

Heard Sri S.A.K. Mynoddin, learned counsel for the petitioner, and Sri P. Durga Prasad, learned standing counsel for APSRTC, appearing for the respondents and perused the record. 3.

Learned counsel for the petitioner has mainly contended that neither compassionate appointment was given to the son of the petitioner nor additional monetary benefit was paid to the petitioner under Bread Winner Scheme and, at least, additional monetary benefit may be paid to the petitioner, in terms of the latest Circular. 4.

Having considered the submissions made by the learned counsel for the parties, this Court is of the view that as contended by the learned counsel for the petitioner, the petitioner is entitled for additional monetary benefit. Therefore, ends of justice would be met, if a direction is given to the respondents to pay the additional monetary benefit to the petitioner.

Accordingly, the writ petition is disposed of directing the respondents to pay the additional monetary benefit to the petitioner, in terms of latest Circular, within a period of four (4) weeks from the date of receipt of a copy of this order.
