This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.516 of 2026 before the KPHB Police Station, Cyberabad Commissionerate, registered for the offence punishable under Section 69 of the BNS. 2.
The case of the prosecution of that the de facto complainant lodged a report before police on 20.04.2026 wherein it is stated that she acquitted with the petitioner in
the year 2021 and thereafter, the petitioner herein under the name of love convinced her saying he would marry her. From 2023 onwards, she has been in physical relationship with the petitioner and later when she insisted the petitioner to marry her he suspected her character. She further submits that for all this, now the petitioner is spreading false propaganda in society about her because of her personal chats, his family members, especially his sister, even though they know about this, have not taken any action and are supporting their petitioner. Hence, she requested the police to take necessary action against the petitioner. Basing on the same, police registered a case for the aforesaid offence.

Heard Sri Kalla Ramakrishna Madhava, learned counsel appearing on behalf of the petitioner and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.
Learned counsel for the petitioner would submit that the relationship between the petitioner and the complainant is a consensual one and that there is no such promise of marriage by this petitioner; that when he enquired about past, he falsely registered a case that the petitioner is
ready to cooperate with the investigation and as such he requested the Court to grant Anticipatory Bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offences alleged the petitioner are grievous and serious in nature; that investigation is not yet completed and hence, he prays to dismiss the petition.

Considering the submissions made by learned counsel for both counsel and taking into consideration the facts and circumstances of the case, the relationship between the petitioner and the complainant is a consensual one from the year 2023 and they were in physical relationship in the year 2023. When the complainant insisted the petitioner to get marry in the month of April, 2026, he refused for the same. Considering the said submissions, this Court deems it fit to grant pre-arrest bail to the petitioner subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, KPHB Police Station, Cyberabad Commissionerate, within two weeks from today, and on such surrender, the said Station House Officer
shall release him on bail on executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case. iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
