THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Criminal Petition No.3040 of 2017 ORDER:
The present petition, under Section 482 of the Code of Criminal Procedure (for short, 'the Code'), is filed requesting to quash the order dated 31.1.2017 passed in Crl.M.P.No.264 of 2017 in C.C.No.358 of 2016 by the Special Magistrate-IV at Visakhapatnam, wherein and whereby the learned Special Magistrate allowed the petition filed by the petitioner under Section 311 of the Code of Criminal Procedure seeking to call for P.W.1 for the purpose of further chief-examination to receive the promissory note, however, subject to payment of costs of Rs.750/- by the petitioner.

Heard Sri C.Sharan Reddy, the learned counsel for the petitioner and the learned Assistant Public Prosecutor for the State of Andhra Pradesh and perused the material available on record. 3.
There is no patent illegality in passing the order which is now challenged in the present Criminal Petition under Section 482 of the Code of Criminal Procedure.

Therefore, the Criminal Petition is dismissed. 5.
Miscellaneous petitions, if any, pending in the Criminal Petition shall stand closed.
