THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Writ Petition No.5953 of 2017 ORDER :

Heard the learned counsel for the petitioner and the 4th respondent in person and the learned Govt.Pleader for Home representing the respondents 1 to 3 and perused the prayer in the writ petition with the supporting affidavit and the material on record.

2. The prayer in the Writ Petition reads as follows: " to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the inaction of the 3rd respondent police in not conducting investigation including arrest of the 4th respondent and another in connection with Crime No 260/2015 dated 09 6 2015 registered under Section 406, 468, 471 and 420 r/w 120-B IPC and 156-3 CrPC even though the petitioner moving before the 3rd respondent round the clock periodically continuously and the police are non taking action only to support the 4th respondent he being a council thereby violated the procedure as contemplated under the law is illegal and arbitrary and in violation of the law and procedure as contemplated under the Act and consequently direct the respondent police to conduct the investigation including steps for arrest and to submit report before the concern court"

3. There is interim direction by this Court on 15.06.2017. It is the submission of the learned Govt. Pleader for Home vis-à-vis the writ petitioner that the police filed final report u/ sec.173 Cr.P.C. Once such is the case as there is nothing further to keep the writ petition pending for any further adjudication, the Writ Petition is disposed of by left open to the writ petitioner/ defacto-complainant to raise any protest against the final report if not taken cognizance by the learned Magistrate. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
