THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.843 OF 2017 ORDER:

This writ petition is filed challenging the registration of F.I.R.No.186 of 2016, dated 27.12.2016 by the second respondent. Learned Government Pleader, on the basis of the written instructions, submits that on the complaint lodged by the fourth respondent, the second respondent registered the crime. He also submits that against the first petitioner herein, another crime being crime No.184 of 2016 was also registered on 27.12.2016 and when the first petitioner filed writ petition in W.P.No.838 of 2017 to quash the said crime, this Court by order, dated 05.01.2017 disposed of the said writ petition directing the respondents not to arrest the first petitioner herein, but the investigation can go on. It is stated that the first petitioner, apart from the present crime, is involved in two more crimes. Learned counsel for the petitioners submits that against the same cause of action, all the crimes are registered and hence, they are not maintainable. In spite of service of notice on the fourth respondent, none appears on his behalf.

In the present writ petition, we are concerned with crime No.186 of 2016 only and in view of the earlier order passed by this Court in W.P.No.838 of 2017, this writ petition is disposed of giving liberty to the respondents 2 and 3 to proceed with the investigation, but shall not arrest the petitioners herein. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall also stand disposed of. __________________________ A.RAMALINGESWARA RAO, J 16.03.2017 pln
