THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.29142 of 2017 ORDER:
The petitioner is doing business in pulses. The case of the petitioner is that the third respondent inspected his business premises on 03.08.2017, seized the stocks of sun flower oil of 1048 kgs, palm oil of 1495 kgs, cotton seed oil of 460 kgs, groundnut oil of 218 kgs, rice bran oil of 29 kgs, totally weighing 3250 kgs by conducting panchanama, and submitted a report to the second respondent. The petitioner filed a petition before the second respondent on 11.08.2017 for release of the seized stock. Without passing any orders in the said petition, the second respondent passed orders on 18.08.2017 directing the Assistant Grain Purchasing Officer, Vijayawada, to dispose of the seized stock by conducting public auction. Challenging the same, the present Writ Petition is filed.
As the petition filed by the petitioner is pending before the second respondent, this Writ Petition is disposed of directing the second respondent to dispose of the petition filed by the petitioner on 11.08.2017 and pass appropriate orders in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. In view of the same, the order dated 18.08.2017 is kept in abeyance, and in the meanwhile, the second respondent shall not sell the seized stock. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
