HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.4400 of 2018 ORDER:

This Petition is filed under Section 482 Cr.P.C. by the petitioner seeking to quash the proceedings against him in Cr.No.57 of 2018 of Inagudurupeta PS, Krishna District registered for the offences under Section 420 IPC and Section 7 of Essential Commodities Act. 2) Investigation is reported to be pending.

3) Having regard to the nature of the accusation and investigation is under way, it is not a fit case to quash the proceedings. However, the Investigating Officer during the course of investigation shall strictly follow the guidelines rendered by Hon'ble Apex Court in the decision reported in Arnesh Kumar vs. State of Bihar1 and also the procedure contemplated under Section 41-A Cr.P.C towards the petitioner. In turn, the petitioner shall cooperate with the investigating agency for smooth completion of investigation.

4) Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
