HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Crl.P. No.4391 OF 2018 ORDER:

This petition is filed under Section 438 Cr.P.C. to enlarge the petitioner on pre-arrest bail in Crime No.325 of 2018 of Jawaharnagar Police Station, Rachakonda, Cyberabad District, registered for the offences punishable under Sections 447, 427 and 506 IPC. Filing of bail application before this Court deviating convention is of serious consequences and unless the petitioner exhausted remedy before the Sessions Court, this Court though having power, normally would not entertain, in view of the judgment of the Apex Court in Gurucharan Singh v State (Delhi Administration)1.

In view of the law declared by the Apex Court, the petitioner is permitted to approach the Sessions Court and file appropriate application. With the above observation, the criminal petition is disposed of giving liberty to the petitioner to approach the Sessions Court for filing appropriate application.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
