THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.12811 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:- "...the petitioner herein prays that this Hon'ble Court may be pleased to issue a Writ Order or direction one more particularly in the nature of Writ of Mandamus declaring the inaction of the respondent Nos.2 to 4 in not conducting investigation in F.I.R.No.273 of 2017 of Ananthapuramu II Town Police Station, though seven months have been elapsed, as illegal, arbitrary and in violation of Articles 14 and 21 of the Constitution of India and contrary to the provisions of the Code of Criminal Procedure and the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act...."

The only grievance of the petitioner is non-compliance of investigation into the case in Cr.No.273/2017 on the file of the II Town Police Station, Ananthapuramu, registered, on 21.10.2017, for the offence under Section 3(1) (r) (s) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, and non-filing of the charge sheet in accordance with the procedure established by law.

Learned counsel for the petitioner submits that, if a direction is given to complete the investigation expeditiously and by following the procedure established by law, the grievance of the petitioner stands redressed.

Learned Government Pleader for Home (AP) endorses the said submission.

Recording the above submissions, the Writ Petition is disposed of, directing the Station House Officer, Ananthapuramu II Town Police Station, the fourth respondent, to complete the investigation into the afore-stated crime expeditiously and file final

report by strictly adhering to the procedure established by law. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
