THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.99 OF 2015 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition reads as under: "...............Writ of Mandamus, or any other appropriate writ, order declaring the action of the Respondent No.4 in calling the petitioner to the police station and threatening with arrest in connection with the FIR.No.195 of 2014 for the offences under Section 353, 323, 506, 34 IPC, Section 3(x) (i) of SC & ST (POA) Act 1989 pending on the file of Police Station, Dharmapurei, Kharimnagar, as illegal, arbitrary and in violation of Article 14 and 21 of Constitution of India and consequently direct the official respondents not to harass the petitioner in connection with the FIR.No.195 of 2014 for the offences under Section 353, 323, 506, 34 IPC, Section 3(x) (i) of SC & ST (POA) Act 1989 and to pass such other order............"

During the course of hearing, learned Government Pleader appearing for respondents 1 to 5 placed on record the written instructions dated 09.09.2019 issued by the Sub-Inspector of Police, Dharmapuri P.S., Jagtial District.

A perusal of the said written instructions would indicate that the petitioner herein was arraigned as accused No.3 for the offences under Section 353, 323, 506, 34 IPC, Section 3(x) (i) of SC & ST (POA) Act 1989. After completion of the investigation, a Charge Sheet was filed on 13.08.2019 before the Sessions Court. It is also mentioned that the Investigation Officer never tried to arrest the petitioner as the petitioner obtained order from this Court for not arresting.

Having regard to the said facts, this Court is of the opinion that no further cause would survive in the present writ petition. Accordingly, the writ petition is dismissed. No order as to costs.

Pending miscellaneous petitions, if any, shall also stand dismissed.
