Simhadri, learned counsel for the petitioners, Sri A. Prabhakar Rao, learned Standing Counsel for the Kaloji Narayana Rao University of Health Sciences and Sri Taddi Nageswara Rao, learned Standing Counsel for the Dr. NTR University of Health Sciences and, with their consent, these Writ Petitions are disposed of at the stage of admission.

All the petitioners herein seek admission into Post Graduate Degree Courses in Dental Surgery in different medical colleges in both the States of Telangana and Andhra Pradesh. While none of them satisfy the criteria of being a local candidate, in terms of the Presidential Order, they claim entitlement, for admission into Post Graduate Degree Courses in Dental Surgery, on the ground that they satisfy the requirement of para-11 of GOP No. 646 dated 10.7.1979 and are, therefore, entitled to be considered for admission into the 15% un-reserved seats required to be provided in terms of the Presidential Order.

While Sri K.V. Simhadri, learned counsel for the petitioners, would raise several other contentions also, he would fairly state that, if the petitioners are considered for admission under the 15% un-reserved category in terms of the Presidential Order and GOP No. 646 dated 10.7.1979, the other contentions urged before this Court need not be gone into, and may be left open to be examined in appropriate legal proceedings.

Both Sri A. Prabhakar Rao and Sri Taddi Nageswar Rao, learned Standing Counsel for the respondents-Universities of Health Sciences,

would fairly state that, in case the petitioners satisfy the requirement of para-11 of GOP No. 646 dated 10.7.1979, their cases would be considered, in the remaining phases of counseling, for admission into Post Graduate Degree Courses in Dental Surgery, being/to be conducted by both the Universities of Health Sciences. We consider it appropriate, therefore, to dispose of both the Writ Petitions directing the Universities of Health Sciences, in both the States of Telangana and Andhra Pradesh, to receive the petitioners' applications, examine whether they satisfy the requirements of para-11 of GOP No. 646 dated 10.7.1979, and, if they are found to have fulfilled the conditions stipulated therein, to then consider their candidature for admission into Post Graduate Degree Courses in Dental Surgery under the 15% un-reserved category seats required to be stipulated in terms of the Presidential Order.

Both the Writ Petitions are disposed of accordingly.

Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
