HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.6145 of 2024 ORDER :

Petitioner/A-23 has filed this petition seeking anticipatory bail in Cr.No.123 of 2024 of P.S. Adibhatla, registered for the offences under Sections 147, 148, 447, 427, 307, 436, 506 r/w.141of IPC. 2.

Heard learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State.

The case of the petitioner is that he has been arrayed as accused in the above crime of trespass, only basing on the confession of A-4 in the crime and that he is not at all concerned with the alleged offences. It is contended that A-10 to A-17 in the said crime were already granted anticipatory bail and that in the event of his arrest, he will be subjected to great hardship. It is contended that the petitioner is a law-abiding citizen and is ready to co-operate with the Police in investigating the case and that he will comply with the conditions that may be imposed by this Court in the event of his release. 4.

The learned Additional Public Prosecutor opposed the application.

Having heard both sides and perused the material on record, this Court is of the considered view that the petitioner can be granted anticipatory bail subject to the following conditions:

1. The petitioner/A-23 shall surrender before the Station House Officer of P.S.Adibhatla within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.20,000/- with two sureties, each for the like sum.

2. The petitioner shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case. The petition is allowed accordingly.
