HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4319 OF 2017 ORDER:
The case of the petitioner is that she was issued notice on 16.09.2016 under Section 7 of the A.P.Land Encroachment Act, 1905, for which the petitioner submitted explanation on 26.09.2016. But the respondents without passing any orders are trying to evict the petitioner.
Learned counsel for the petitioner submits that the petitioner has not encroached Government land and the subject land is a private land which she has purchased through registered sale deed.
Heard the learned Assistant Government Pleader for Revenue.
In view of the above facts and circumstances, since it is stated that petitioner has already filed explanation to the notice dated 16.09.2016, the 4th respondent is directed to consider the same and pass orders, after giving opportunity of hearing to the petitioner. Till passing of final orders, the petitioner shall not be dispossessed from the subject land.
With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
