The petitioner, who is the defendant in OS.No.129 of 2012, on the file of the Court of the learned III Additional District Judge, Guntur, filed by the respondent for declaration of title and recovery of possession of the plaint schedule property, filed this Civil Revision Petition feeling aggrieved by docket order, dated 03-11-2015, allowing IA.No.1174 of 2015 and summoning the Municipal Commissioner for giving evidence and causing production of property tax record and also the opinion of the Standing Counsel, Guntur Municipal Corporation, with regard to the plaint schedule property.

After hearing the learned Counsel for both parties, I am of the opinion that, to the extent of summoning the Commissioner of Guntur Municipal Corporation, for giving evidence and to cause production of property tax record, no exception can be taken. However, as regards the legal opinion of the Standing Counsel for Guntur Municipal Corporation,

the same cannot be summoned as it is a privileged communication besides the fact that it is not relevant evidence.

Therefore, the order under revision to the extent of placing the opinion of the Standing Counsel, Guntur Municipal Corporation before the Court alone is set aside while the remaining part is confirmed.

The Civil Revision Petition is, accordingly, allowed to the extent indicated above.
