THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.15129 OF 2019 Date:22.07.2019 Between:
Smt. Indrani Prasad, W/o. P.S. Prasad, Aged 72 years, R/o.506, A.C. Sharma Complex, S.D.Road, Secunderabad .. Petitioner And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat Complex, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.15129 OF 2019 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
2.
The application submitted by the petitioner seeking conversion of agricultural land for non-agricultural purpose to an extent of Acs.12.00 in Survey No.1 of Hasmathpet Village, Balanagar Mandal, Medchal Malkajgiri District, is rejected by the Revenue Divisional Officer, Malkajgiri Division, vide memo dated 08.06.2017. The said decision is under challenge in this Writ Petition.
3.
Against the decision rejecting application seeking conversion of land for non-agricultural purpose, remedy of appeal is available under Section 8 of the Telangana State Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 (for short, 'the Act'). Without availing the said remedy, this Writ Petition is filed.
4.
Since an effective and efficacious remedy is available to the petitioner, the Court is not inclined to entertain the Writ Petition. 5.
At this stage, learned counsel for the petitioner sought to contend that the memo dated 08.06.2017 was not served on the petitioner but was served on the developer and after knowing the said decision, he filed this Writ Petition. However, these are all matter to plead before the appellate authority by furnishing
reasons why appeal could not be preferred immediately after the order was made and to satisfy the appellate authority. 6.
The Writ Petition is accordingly dismissed leaving it open to the petitioner to avail the remedy of appeal under Section 8 of the Act against the decision of the Revenue Divisional Officer, dated 08.06.2017. Pending miscellaneous petitions, if any, shall stand closed.
