THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.1135 of 2013 ORDER:
The order, violation of which is alleged in this Contempt Case, is the order passed in W.P.No.5831 of 2013 dated 01.03.2013, whereby the 2nd respondent was directed to dispose of either the appeal or the stay petition in accordance with law within a period of two months from the date of receipt of a copy of the order. In the counter affidavit, it is stated that the 2nd respondent has disposed of the appeal filed by the petitioner, and three others, on 19.12.2013, and had remanded the case to the Joint Collector, Prakasam.
While there is, no doubt, a delay in complying with the order, the delay is not so inordinate as to justify punishing the respondents under the Contempt of Courts Act. I see no reason, therefore, to proceed against the respondents under the Contempt of Courts Act. The Contempt Case is, accordingly, closed. The Contempt Applications, pending, if any, shall also stand closed. There shall be no order as to costs.
