THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.35295 OF 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondents in not finalising the retirement and pension benefits of late Gummadi Nageswara Rao, who retired from service on 31.07.2013 having attained the age of superannuation and died on 27.07.2014, in favour of the petitioner, who is his legally wedded wife, as illegal and arbitrary.

2. The case of the petitioner is that her husband, late Gummadi Nageswara Rao, worked as Fountain Cleaner in respondent No.1 - Corporation vide Employee No.1573 and retired from service on 31.07.2013 having attained the age of superannuation. He passed away on 27.07.2014. As the respondents have not finalised his retirement and pension benefits, she submitted a representation on 22.01.2015. Since there was no response, she got issued a legal notice to respondent No.1 on 09.08.2016. In spite of the same, no action is taken yet. Aggrieved by the same, the present Writ Petition is filed.

3. Heard learned counsel for the petitioner and the learned Standing Counsel for respondent No.1 - Corporation.

4. In view of the facts and circumstances, respondents are directed to consider the representation of the petitioner submitted on 22.01.2015 for grant of retirement and pension benefits of her

husband, late Gummadi Nageswara Rao, in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. ___________________________ A. RAJASHEKER REDDY, J October 24, 2016.
