HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39746 OF 2016 ORDER:

The present writ petition under Article 226 of the Constitution of India is filed seeking to declare the proceedings against the petitioners in CC No.455 of 2015 on the file of XIV Additional Chief Metropolitan Magistrate, Hyderabad, as illegal and arbitrary and consequently, quash the same.

Heard and perused the material available on record. After perusing the record, when this Court expresses its opinion that this Court is not inclined to grant the relief sought for by the petitioners, learned counsel for the petitioners confined his arguments and requested to dispense with the presence of the petitioners before the Court below.

Hence, in view of the submission of the learned counsel for the petitioners, the presence of the petitioners before the Court below is dispensed with, except on the dates on which the learned Magistrate insists for their appearance.

Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
