Heard learned counsel for the petitioners and learned Government Pleader for respondents.
This writ petition was filed challenging the inaction on the part of the respondents in granting patta for an extent of Acs.11.14 cents in survey No.339/2, Acs.6.60 cents in survey No.340/2 and Acs.8.97 cents in survey No.341/2 of Vootupalle Village, Sodam Mandal, Chittoor District. The learned counsel for the petitioners submits that the proceedings are pending before the Chief Commissioner of Land Administration, Andhra Pradesh, Hyderabad and though he called for a record wayback on 29.12.2001, and when no progress was there in the case, in view of the threat of dispossession, the present writ petition was filed.
The respondents also filed a counter affidavit stating that the matter is under consideration by the revenue authorities and necessary survey was conducted and orders for rectification of entries relating to boundary of two villages and petitioners' claimed lands would be passed. Since the matter is pending before the Chief Commissioner of Land Administration with regard to wrong correlation to survey numbers and corrections to be made to Vootupalle survey numbers, this Court is not inclined to entertain the present writ petition except directing the Chief Commissioner of Land Administration, Andhra Pradesh, to dispose of the application of the petitioners for correction of survey numbers in respect of survey Nos.75/2, 4, 5, 8 and 9 of Palamanda Village, Chittoor District in accordance with law on the basis of the records submitted to him and pass appropriate orders thereon within a period of six months from the
date of receipt of copy of this order. Till such time, no coercive steps shall be taken against the possession of the petitioners. The writ petition is accordingly disposed of.
