HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19095 OF 2009 ORDER:

This Writ Petition is filed for the following relief: "...that this Hon'ble Court may be pleased to call for the records from the Respondents herein by issuing a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus by declaring the respondents herein Proc.No.TR2/255(15)/98-PO-II(2) dated 23.1.1999 in so far as not regularizing my service in the post of Superintendent (Traffic) from the date of my initial appointment i..e, 8.1.1992 to 30.8.1998 as arbitrary, illegal, contrary to the APSRTC Service Regulations 1964 & APSRTC Recruitment Regulations 1966 and also in violation of Articles 14 and 21 of the Constitution of India, and consequently direct the respondent herein reckoning the period from 8.1.1992 to 30.8.1998 for all purposes seniority promotion etc. and to grant such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Both the learned counsel submits that this writ petition is similar to the one considered by this Court in W.P.No.25634 of 1999, dated 01.07.2010, which was disposed of upholding the impugned order therein directing that the petitioners therein shall be entitled for the benefit of the services rendered by them, ever since the date of their initial appointment.

Learned counsel for the petitioner submits that in similar circumstances based on the orders of this Court in the said writ petition, the benefit of regularization with effect from the initial date of appointment was extended to the similarly situated people and seeks a similar direction to the respondent-Corporation to consider the case of the petitioner herein also.

4. Following the same and without expressing any opinion on

merits, this writ petition is disposed of directing the respondents to reconsider the case of the petitioner, in the light of the orders passed by this Court in W.P.No.25634 of 1999 dated 01.07.2010, and if similar facility has been extended to others, petitioner may be treated on par with others within six weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
