THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12977 OF 2016 ORDER:

This petition is filed by the petitioner-A6 under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.148 of 2016 on the file of Suryaraopet Police Station, Vijayawada, registered for the offence punishable under Sections 307 and 498-A r/w 34 IPC. Heard and perused the material available on record. The petitioner is the brother of A1. A1 is the husband of the 1st respondent. It is alleged that A1 along with the other accused in the above crime harassed the 1st respondent.

Learned Counsel for the petitioner submitted that the petitioner is staying in Japan and he is no way concerned with the allegations made in the complaint and that the petitioner was falsely implicated in the above crime.

Learned Additional Public Prosecutor opposed this petition. The truth or otherwise of the allegations cannot be decided by this Court. Considering the facts and circumstances of the case and the nature of the allegations made against the petitioner, this Court is not inclined to grant the relief sought by him. However, the 2nd respondent-police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioner. The petitioner is directed to appear before the Station House Officer concerned as and when required. Accordingly, the Criminal Petition is disposed of.
