THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.12971 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Home for Respondent Nos.1, 6 to 8 and learned Government Pleader for Fisheries for respondents 2 to 5. 2.

This writ petition is filed complaining inaction of respondent Nos.6 to on the complaint of the petitioner dated 24.03.2018 vide receipt No.273, to prevent the other community persons to catch fish in the Ryalampadu Reservoir. 3.

The brief facts are that the petitioner Society was authorized to catch fish in Ryalampadu Reservoir for the previous years and for the year 2018 also, it had deposited the lease amount. However, on account of the disputes with the land outstees, the amounts were kept in fixed deposit as per the direction of this Court. The grievance of the petitioner is that though this Court had prohibited either of the parties from catching fish, the land outstees are catching fish in the reservoir. In those circumstances, the petitioner filed a complaint on 24.03.2018 before respondent Nos. 6 and 8, but no action has been taken thereon.

The 4th respondent filed counter-affidavit denying the allegations made in the writ affidavit. It is stated that neither the petitioner Society nor the other community persons are permitted to

CKR, J W.P.No.12971 of 2018 carry on fishing operations on account of the law and order situation and pendency of various cases before this Court. 5.

In the light of the averments in the counter-affidavit that no permission was given to either of the parties for catching fish in Ryalampadu reservoir, the relief sought for by the petitioner cannot be considered at this stage.

Hence, the Writ Petition is closed as infructuous. No order as to costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
