HON'BLE SRI JUSTICE A.RAJASHEKER REDDY AND HON'BLE SRI JUSTICE M.LAXMAN IA.No.2 OF 2021 IN/AND FCA.No.96 OF 2021 JUDGMENT:(per Hon'ble Sri Justice A.Rajasheker Reddy) This appeal is filed against the Order and Decree dated 29.05.2021 passed in FCOP.No.63 of 2017 on the file of the Family Court-cum-VI Additional District Judge, Khammam District. During the pendency of the appeal, the Appellant-husband and the respondent-wife have amicably compromised the matter and are ready to take mutual divorce in terms of the compromise. Accordingly, I.A.No.2 of 2021 was filed by the Appellant/husband seeking decree of divorce in terms of memorandum of compromise by dissolving the marriage between them. The Appellant/husband had filed memorandum of compromise along with IA.No.2 of 2021 stating that they have amicably compromised the matter. Heard learned counsel for the appellant as well as learned counsel for respondent.

The appellant-husband and respondent-wife are present in person through virtual mode and they are identified by their respective counsel.

The respondent/wife submits that she is agreeable to receive Rs.18,00,000/- towards full and final settlement including permanent alimony and she also received Rs.10,00,000/- in cash. The Appellant-husband submits that for the remaining amount of Rs.8,00,000/- a Demand Draft No.035606, dt.25.11.2021 was

drawn in the State Bank of India, Bhadrachalam Branch in the name of the respondent-wife and the same was with one M.Pradeep Anirudh, who is mediator; and that the said DD will be handed over to the respondent-wife immediately after closing of Civil and Criminal cases pending between them. The said arrangement was also agreed by the respondent-wife.

In view of the above, the Compromise entered into between the parties is hereby recorded and IA.No.2 of 2021 is ordered. A decree be drawn in accordance with the terms of Compromise and a copy of Memorandum of Compromise filed by the Appellanthusband shall form part of the record. Accordingly, the FCA is disposed of in terms of Compromise entered into between the parties and the order and decree dated 29.05.2021 passed in FCOP.No.63 of 2017 (HMOP.No.151 of 2015) on the file of the Court of Family Court-cum-VI Additional District Judge at Khammam District, is set aside granting divorce to the parties by mutual consent.

Miscellaneous petitions, if any, pending in the FCA shall stand dismissed.
