THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.7323 of 2008 ORDER:

This Writ Petition is filed for the following relief: "to issue a Writ of Mandamus or any other appropriate Writ, order or direction, declaring the action of the respondents in issued notification under Section 4(1) of the Land Acquisition Act in Roc.G1/5482/07 dated 29.11.2007, subsequent Sec.5A notice and Sec.6 declaration in Rc.G4.5482/07 dated 16.02.2008 for acquiring the petitioner land to an extent of Ac.9.39 cents out to total wet land admeasuring Ac.13.50 in Survey Nos.170/1, 169, 171/1 to 171/3 situated at Motur village in Gudivada Mandal, Krishna District, as illegal, arbitrary and violative of principles of natural justice and consequential direct the respondents to drop all further proceedings in this regard and pass such other order or orders as this Hon'ble Court may deem fit and proper." 2.

When the matter is taken up for hearing, learned Government Pleader for Land Acquisition (A.P.) placed on record the written instructions received from the Revenue Divisional Officer, Gudivada. The relevant portion of which reads as under: "In this connection, it is submitted that, counter affidavits in W.P.No.5770/2008, 5726/2008, 5886/2008, 6331/2008, 7323/2008 has already submitted and Additional Counter affidavits was also submitted on 01.05.2015 duly submitting the fact that the land in question should be withdrawn from acquisition proposal as the requisition department has already submitted requisition proposals and withdrawal proposals U/s.48(1) was already submitted to the Collector, Krishna on 07.05.2015 in Rc.G.1333/2007 and the withdrawal proposal is under active consideration to withdraw the subject land of the petitioners for an extent of Ac.60.98 cts in R.S.No.158, 170/1 etc, of Moturu Village of Gudiavada Mandal."

In the light of the above, no further relief is required to be granted in this Writ Petition. Accordingly, this Writ Petition is closed. No order as to costs.

Consequently, miscellaneous petitions, if any shall stand closed.
