THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3952 OF 2022 ORDER:

This Criminal Petition under Section 437 and 439 Cr.P.C is filed by the petitioner, who is arrayed as soled accused in Crime No.53 of 2022 of Kukatpally Police Station, Cyberabad, registered for the offences punishable under Sections 304-II of Indian Penal Code and Sections 181, 184, 196 of the Motor Vehicle Act, seeking bail. 2.

Heard the learned Counsel appearing for the petitioner and the learned Assistant Public Prosecutorrespondent for the State. 3.

According to the prosecution the present complaint was lodged on 15.11.2022 wherein it was stated that while the complainant was crossing the road a two wheeler came with a pillion rider and hit the complainant, as a result he fell down, for which reason initially the complaint was registered for the offence under Section 337 of Indian Penal

Code and Section 181 of Motor Vehicles Act and subsequently the injured died, for which reason Section of Law was altered to Section 304-II of Indian Penal Code and Sections 181, 184, 187 and 196 of the Motor Vehicles Act. 4.

The petitioner is a student and he was remanded to judicial custody on 14.03.2022. As the case is one of accident the petitioner can be released on bail. 5.

The Criminal Petition is accordingly allowed. The petitioner/accused shall be enlarged on bail in connection with Crime No.53 of 2022 of Kukatpalli Police Statiton, on his furnishing personal bond for Rs.50,000/- (Rupees fifty thousand only) with two sureties for a like sum each to the satisfaction of the Principal Junior Civil Judge-cum-VIII Additional Metropolitan Magistrate, Kukatpally. Miscellaneous petitions pending, if any, shall stand dismissed.
