The Court made the following: [order follows] WRIT PETITION NO. 402 OF 2012 O R D E R :

The petitioners challenge the auction conducted on 16/12/2011 of property bearing Nos. 15-9-132, 15-9-133, and 15-9133/1 to 15-9-133/4, Choulta Maharaj Gunju, Gowliguda Chaman, Hyderabad, as illegal, contrary to procedure stipulated under Rule 52 of A.P. Co-operative Societies Rules and arbitrary.

2. At the time of hearing, learned standing counsel appearing for respondents 2 and 3 in the writ petition submits that the fifth respondent, who has purchased the subject property of the writ petition in the auction held on 16/12/2011 could not be completed. The Bank intends to conduct fresh auction if circumstances so warrant. As the sale initiated is aborted, it is needless to observe that the respondents have to follow the procedure for auctioning the subject property of the writ petition.

3. The statement of the learned standing counsel is placed on record and the writ petition is disposed of accordingly. No order as to costs.

4. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
