THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.23146 of 2010 ORDER:

The grievance of the petitioners was that the police authorities were interfering with their life and liberty in the guise of investigating Crime No.63 of 2010 on the file of Chennur Police Station, Chennur, YSR Kadapa District.

By order dated 17.09.2010, this Court directed the respondents not to interfere with the petitioners' life and liberty except as required under law.

The Inspector of Police, Kadapa Urban Circle, YSR Kadapa District, filed a counter-affidavit stating that Crime No.63 of 2010 was registered under Section 420 I.P.C. read with Section 7(1) of the Essential Commodities Act, 1955, in relation to the clandestine transport of fertilizers in some lorries. The petitioners were also named as the co-accused in the said crime. However, as the subject matter of the case was fertilizers, an agricultural commodity, and as the police authorities prima facie found that no case was made out under Section 420 I.P.C., the case was transferred to the Agriculture Department at Kadapa under letter dated 23.09.2010. It is further stated that the entire matter was pending consideration with the Agriculture Department.

In the light of the afore-stated averments made by the Inspector of Police, Kadapa Urban Circle, the grievance of the petitioners stands redressed as the case is no longer with the police authorities but has been transferred to the Agriculture Department. The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
