THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.15052 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the inaction of respondents 1 to 3 in completing the investigation in crime No.39 of 2016 of Amrabad Police Station registered against respondents 4 to 6 for the offences punishable under Sections 447, 427, 324 and 506 read with 34 of Indian Penal Code, as illegal and contrary. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. At the time when the matter is taken up for hearing, the learned AGP submits that pursuant to the registration of crime, the respondent-Police investigated into the matter and filed a charge sheet, which was numbered as C.C.No.

129 of 2017 on the file of the Judicial First Class Magistrate, Achampet, Nagarkurnool District. Such being the position, it cannot be said that the respondent-Police have not investigated into the matter. The second grievance of the petitioner in this writ petition is that the unofficial respondents are harassing the petitioner by registering another crime in spite of civil proceedings being pending before the Agency Court. He also placed on record a copy of FIR dated 09.05.2017 in crime No.71 of 2017 registered for the offences punishable under Sections 188, 447 and 427 read with 34 of Indian Penal Code.

If really, the unofficial respondents are acting contrary to any order passed by the Civil Court, the petitioner is at liberty to approach the said Court for appropriate relief, in which event, the same shall be dealt with in accordance with law, at the earliest. Accordingly, the Writ Petition is disposed of. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. There shall be no order as to costs. ________________________ C.
