HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.487 of 2016 ORDER:

This revision is preferred challenging the order dated 08-02passed in Crl.M.P.No.279 of 2016 in C.C.No.288 of 2015 on the file of the I Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, wherein the learned Magistrate dismissed the petition filed by the petitioner Nos.2 and 3 - accused Nos.2 and 4 to recall the N.B.W. The learned counsel for the petitioner Nos.2 and 3 - accused Nos.2 and 4 submitted before this Court that petitioner Nos.2 and 3 - accused Nos.2 and 4 are ready to face the trial and they will not flee from the hands of justice.

Having heard the learned counsel for the petitioners and the learned Public Prosecutor and having perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions :

The petitioner Nos.2 and 3 - accused Nos.2 and 4 are directed to surrender before the Court concerned on or before 10-03-2016 and file a petition to recall the warrants issued against them and on such filing of a petition, the trial Court is directed to recall the warrants on the same day on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum each and further the petitioner Nos.2 and 3 - accused Nos.2 and 4 are directed to appear before the trial Court regularly. Till 1003-2016, the operation of the order issuing N.B.W. is suspended. Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
