THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.2757 of 2009 ORDER:

Petitioner prays for the following relief:

"... to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the order dt.05-012009 passed in Appeal proceedings No. SRC (2) 406/2008 passed by the 1st respondent whereby rejecting the Appeal which was passed in confirming the proceedings dt.19-06-2008 in SR Cell (1)/S & HVP (1) 1348/2004 passed by the 2nd respondent whereby cancelling the licence of the petitioner as the same is illegal, arbitrary and violative of principles of natural justice, and consequently direct the respondents to renew licence bearing No. 218 granted in favour of M/s. Venkateswara Hybrid Seeds, Adoni, Kurnool District and also issue a certificate of registration under the provisions of A.P. Cotton Seeds (Regulation of Supply), Distribution, Sale and fixation of Sale Price Act 2007 ..."

This Court, on 13.02.2009, passed the following interim order: "In the facts and circumstances of the case, the petitioner is directed to file a fresh application along with all other requisite formalities required for seeking renewal of the application for licence, within a period of three weeks from today. On filing such application, the second respondent is directed to take up the same and dispose of the said application, as per law, within a period of four weeks thereafter."

3. Counsel appearing for petitioner submits that the request of petitioner, in fact, was considered and rejected by the authorities. Having regard to the subsequent developments, counsel submits that the cause in the writ petition does not survive.

The writ petition is dismissed as infructuous. However, liberty to assail the rejection order is granted to petitioner. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
