THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.39957 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner seeks deletion of his land from the list of assigned lands submitted by the Tahsildar, Anandapuram Mandal, Visakhapatnam, the 4th respondent. He states that the subject land is a patta land and not assigned land.

Apparently, the petitioner has a remedy to make an appropriate application under Section 22-A (4) of the Registration Act, 1908 to the competent authority and the 4th respondent being not the competent authority, the application filed by the petitioner on 01.12.2015 cannot be taken note of.

Hence, the Writ Petition is dismissed giving liberty to the petitioner to make an appropriate application before the competent authority. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
