THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3879 OF 2022 ORDER:

This criminal petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in connection with crime No.899 of 2021 on the file of Station House Officer, Malkajgiri, Rachakonda, wherein the petitioner/Accused No.3 is alleged to have committed the offences punishable under Sections 366 and 376-D of Indian Penal Code and Section 3(2)(v) SC/ST POA Act, 2015 and Section 5 read with Section 6 of POCSO Act, 2012. 2.

Heard the learned counsel for the petitioner/Accused No.3 and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that the de facto complainant lodged a complaint on 10.12.2021 stating that Accused No.1 followed the victim and exchanged mobile numbers. One day while the victim was in shop, Accused No.1 forcibly took the victim to his house and obtained nude photographs of the victim, since then he

started harassing the victim. By showing the said photographs Accused Nos.1 to 3 had sexual intercourse with the victim. 4.

As seen from the record, the investigation is completed, charge sheet is also filed and the Sessions Court by order dated 11.03.2022 enlarged Accused No.1 on bail, in the said circumstances, the petitioner/Accused No.3 can be granted bail. 5.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.3 is granted bail subject to the following conditions:

i) The petitioner/Accused No.3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the IX Additional District and Sessions Judge (FTC), Ranga Reddy District at L.B.Nagar.

ii) The petitioner/Accused No.3 shall appear before the trial Court on every date of hearing.

iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 28.04.2022 ns
