THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL REVISION CASE NO.2226 OF 2017 ORDER:

This Criminal Revision Case is filed under Sections 397 & 401 of Cr.P.C questioning the order passed by the VIII Metropolitan Magistrate, Cyberabad at Rajendranagar, Ranga Reddy District on 09.10.2015 in D.V.C. No.13 of 2012.

But Sri R.Siva Sai Swaroop, learned counsel for the revision petitioner fairly accepted that the appeal lies under Section 29 of Protection of Women from Domestic Violence Act, 2005 and requested this Court to permit him to file the same before the Sessions Court and the limitation for filing an appeal starts from the date of service of order copy either on the aggrieved person or on the respondent whichever is later.

Accordingly, the Criminal Revision Case is dismissed giving liberty to the petitioner to file an appeal before the Sessions Court within 30 days from the date of service of order copy. Registry is directed to return the material papers filed along with this petition to the counsel on record with proper acknowledgement immediately.

Consequently, miscellaneous applications pending if any, shall stand dismissed. No costs.
