HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Transfer Civil Miscellaneous Petition No.548 of 2016 ORDER:

Learned counsel for the petitioner, though, seeks time without getting ready for disposal of the present Transfer Civil Miscellaneous Petition, which is filed to withdraw F.C.O.P. No.246 of 2016 pending on the file of Family Court-I, Visakhapatnam, to the Family Court at Rajahmundry, East Godavari District. But, the learned counsel for the respondent, Sri S.V.R. Subrahmanyam, would submit that the very F.C.O.P. itself was disposed of. Learned counsel for the petitioner now comes out with the submission that F.C.O.P. was dismissed for default and there is likelihood of restoring it, and seeks permission to re-agitate the issue by filing fresh petition in case F.C.O.P. is restored to file.

Giving such liberty, the present Transfer Civil Miscellaneous Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions if any pending in the present Transfer Civil Miscellaneous Petition shall stand closed. ________________________ A.SHANKAR NARAYANA Dt. 01.05.2018 gbs
