THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.38832 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners made an application, dated 11.03.2015 (Ex.P1), for conducting survey and are stated to have enclosed a challan showing that requisite fee was also paid. Alleging that in spite of their number of requests, the survey has not been ordered by the Tahsildar, Dammapet Mandal, Khammam District, the 3rd respondent, the present Writ Petition is filed. Learned Government Pleader for Revenue, on instructions, submits that the petitioners have neither approached the office of the 3rd respondent nor submitted any application along with the challan and now requested for conducting survey. He also states that Survey No.884/1 regarding which the request is made is a vast extent of Acs.802.20 guntas of land and without sub-division record, it is not possible to conduct survey.

After hearing both the counsel, it is apparent from the record that the petitioners have already made an application and paid requisite fee and challan to that effect is also produced. Hence, I deem it appropriate to dispose of the Writ Petition directing the petitioners to file copies of the application and the challan again before the 3rd respondent, who shall examine and consider the same. Since it is stated that sub-division record is also necessary, it is open to the 3rd respondent to call upon the petitioners to pay the requisite fee for the sub-division record for conducting survey.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
