THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 42488 of 2016 ORDER:

This writ petition is filed challenging the action of respondent No.2-Station House Officer, IV Town Police Station, Nellore, SPSR Nellore District in implicating the petitioner in Crime No.196 of 2016, dated 15.07.2016.

A reading of the complaint shows that the petitioner was working as Junior Assistant in the Court of Additional Judicial Magistrate of First Class, Gudur and he was under suspension as on the date of the complaint. The complaint was lodged by the Chief Administrative Officer, Principal District Court, Nellore on the ground of misappropriation of funds.

In view of the allegation made in the complaint, the registration of the crime cannot be found fault. This Court sees no ground to interfere with the registration of the crime. Hence, the writ petition is dismissed. It is needless to observe that while investigating the crime, the Police shall follow due process of law.
