THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15166 OF 2019 O R D E R :

This writ petition is filed challenging the action of the 2nd respondent in not taking any action on the representation dt.04.07.2019 submitted by the petitioner seeking police aid for erection of Telecommunication Tower on the terrace of building bearing H.No.2100/3, Plot No.3 Part, Sy.No.169, Sri Sai Surya Enclave, Macha Bollaram, Secunderabad.

Learned Assistant Government Pleader for Home basing on the written instructions dt.24.07.2019 submitted by the Sub-Inspector of Police, Alwal P.S., Cyberabad Commissionerate, submits that on receipt of representation from the petitioner, GD entry was made and enquiry was being done; that during the enquiry the Station House Officer addressed a letter to the Manager, Indus towers, Gachibowli, Hyderabad (petitioner herein) to submit 'No Objection Certificate' and all relevant documents for installation of Telecommunication Tower; and that after receiving necessary documents from the petitioner, action will be taken as per law.

Learned counsel for the petitioner submits that after receiving the letter dt.23.07.2019 from the Station House Officer, the petitioner has submitted all the relevant documents as required by the respondent police on 25.07.2019. He further submits that this Court in similar

circumstances disposed of WP.No.14941 of 2016 on 28.04.2016 which was followed by this Court in WP.No.6213 of 2018, dt.05.03.2018. Having regard to the aforesaid facts and circumstances, the writ petition is disposed of directing the Station House Officer, Alwal Police Station, Cyberabad, to consider the petitioner's representation dt.04.07.2019 and take action in the matter in accordance with the due procedure laid down by law. This exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
