HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.122 of 2016 ORDER:
This petition is filed to withdraw H.M.O.P.No.14 of 2015 from the file of VII Additional District Judge-cum-Family Court, Eluru, West Godavari District and transfer the same to Family Court, Rajahmundry, East Godavari District.
2. Wife filed this petition. According to her affidavit her marriage with respondent was performed on 21.02.1996 at her parents' house at Ramachandrapuram, East Godavari District and marriage was consummated and a male child was born on 20.05.1998. According to her affidavit due to differences she is living with her parents and respondent filed HMOP No.14 of 2015 before Family Court, Eluru for dissolution of marriage and she filed MC No.6 of 2016 before IV Additional Junior Civil Judge, Rajahmundry and that respondent is attending Rajahmundry Court and contesting the maintenance case. She further stated that when she attended Eluru Court on 06.01.2016 she was attacked and she lodged a complaint with III Town police, Eluru and as she apprehends life threat at Eluru, prayed for transfer of OP from Eluru to Rajahmundry.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

5. Considering the reasons stated in the affidavit and also considering the fact that respondent is already attending Rajahmundry Court in connection of Maintenance case filed by
wife, the request of wife for transfer of OP from Family Court, Eluru to Family Court, Rajahmundry is considered.
6. For these reasons, H.M.O.P.No.14 of 2015 is withdrawn from the file of VII Additional District Judge-cum-Family Court, Eluru, West Godavari District and transferred to Family Court, Rajahmundry, East Godavari District for disposal in accordance with law.
7. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. __________________ S. RAVI KUMAR, J Date: 16-03-2016 gvl
