2. Petitioner was awarded contract for transportation of animals under the Transport of Animals (Amendment) Rules, 2009, from various parts of Maharastra and Andhra Pradesh States to Jagitial District. The contract awarded to the petitioner commenced from 14.06.2017 and was valid for a period of two years. Thus, by 13.06.2019 the contract period of the petitioner expired. On 10.07.2019, fresh tenders are floated calling for enlistment to transport sheep under sheep rearing scheme from various places. Petitioner is challenging the said notification.
3. According to the learned senior counsel, as the petitioner is an existing contractor having valid transport contract, the areas covered by the petitioner's contract cannot be now notified and the same is illegal.
4. As briefly noted above, the contract entered into by the petitioner ended on 13.06.2019 as the period of contract was over by the said date and as of now there is no subsisting contract. Thus, it is open to the respondent to float fresh tenders and to enlist new contractor. Therefore, the contention of the learned senior counsel that the petitioner has subsisting contract and during subsistence of contract, new tenders cannot be floated has no merit.
5. Therefore, the Writ Petition is dismissed. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
