THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION NOs.17353 AND 17376 OF 2021 COMMON ORDER:
Mr. K. Subrahmanyam, learned counsel for the respondents, fairly conceded that the Revenue Divisional Officer, who passed the order dated 18.10.2019 in ROR Appeal No.D2/2154/2018, was also one of the members of the Revenue Tribunal, which passed the orders dated 09.06.2021 in Case No.F2/3426/2019 and Case No.F2/3430/2019 respectively.

In view of the same, without going into merits of this case, on this limited ground, both the Writ Petitions are allowed setting aside the orders dated 09.06.2021 in Case No.F2/3426/2019 and Case No.F2/3430/2019 passed by the Revenue Tribunal and both the revision petitions are restored to file.

It is stated that the Additional Collector, Sri S. Mohan Rao, since retired. In the circumstances, the Revenue Tribunal shall dispose of both the revisions in Case No.F2/3426/2019 and Case No.F2/3430/2019 by issuing notice to both the parties and hearing them.

There shall be no order as to costs.
Miscellaneous applications, if any, pending shall stand closed.
