THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION Nos.26310 and 26319 of 2010 COMON ORDER:

The grievance of petitioners is substantially same and similar in the writ petitions as well as miscellaneous petitions. On 25-10-2010, this Court issued the following interim direction to 5th respondent.

" Heard the learned counsel appearing for the petitioner. Learned counsel appearing for the petitioner submits that No Objection Certificate can directly be issued by the Tahsildar and there is no necessity to forward the application seeking no objection to the Collector.

Learned counsel refers G.O.Ms.No.181, Industries & Commerce (Mines-I) Department, dated 28.05.1998, wherein it is stated that the Mandal Revenue Officer will send his report to the Assistant Director of Mines & Geology within a period of 30 days duly marking a copy of his report to the District Collector. The reports of the Mandal Revenue Officer need not be routed through the intermediate level of Revenue Divisional Officer/ Sub-Collector. In that view of the matter, respondent No.5 is directed to send his report on the petitioner's application to the Assistant Director of Mines and Geology, Palamaneru, Chittoor District, directly in accordance with G.O.Ms.No.181, dated 28.05.1998." Sri R.Radha Krishna Reddy counsel for petitioners submits that the respondents have not in fact acted in the manner as directed by this Court and have not filed counter affidavits and requests the Court to make the interim order as final order and order the writ petitions accordingly.

I have perused the writ prayers and I am satisfied that the interim order dated 25-10-2010 can be made as final order in the writ petitions.

Hence, the interim order dated 25-10-2010 is made as final order and the writ petitions are disposed of accordingly. No order as to costs.
