THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Writ Appeal No.601 of 2018 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the ad-interim order passed by the learned Single Judge in I.A. No. 1 of 2018 in W.P. No. 10574 of 2018 dated 2.4.2018. All that the learned Single Judge has granted, by way of the order under appeal, is interim directions as prayed for.
While Sri R. Siva Sai Swaroop, learned counsel for the appellant3rd respondent, has put forth his submission on merits, it must be borne in mind that the order under appeal is merely an ad-interim order. It is always open to the appellant-3rd respondent to file a counter-affidavit, and seek vacation of the said interim order, raising all such contentions as are available to him in law. Leaving it open to the appellant-3rd respondent to do so, the Writ Appeal fails and is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
