HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.27081 OF 2001 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not promoting the petitioner to the post of Physical Science B.Ed., Assistant in Y.R.S. High School, Rentachintla, as arbitrary and illegal, and consequently, to set aside the proceedings of the 1st respondent dated 26.12.2001, and to direct the respondents to consider the case of the petitioner for promotion to the post of Physical Science B.Ed Assistant.

Heard Sri K.S. Murthy, learned Counsel for the petitioner and the learned Government Pleader for Education. 3.

It has been contended by the petitioner that his case is not being considered by respondents Nos.1 and 2 for promotion on the ground that he filed W.P.No.17902 of 2000 against the suspension orders issued by respondents Nos.1 and 2.

The learned Government Pleader submits that until and unless respondents Nos.1 and 2 promote the petitioner, they cannot give any approval for such promotion.

Having considered the above submissions, this Court is of the view that without expressing any opinion on merits, this writ

petition can be disposed of directing respondents Nos.1 and 2 to consider the case of the petitioner for promotion to the post of Physical Science B.Ed. Assistant without any reference to the impugned order dated 26.12.2001.

Accordingly, the Writ petition is disposed of directing respondents Nos.1 and 2 to consider the case of the petitioner for promotion to the post of Physical Science B.Ed., Assistant without any reference to the impugned order dated 26.12.2001, and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.
