THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.4919 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioners-accused Nos.1 and 2 in C.C. No.249 of 2014 on the file of the Court of I Metropolitan Magistrate, Vijayawada.

At the time of hearing, learned counsel for the petitioners submitted that the petitioners have filed Crl.M.P. No.2010 of 2015 under Section 239 of Cr.P.C., to discharge him in C.C. No.249 of 2014. The only relief sought by the learned counsel for the petitioner is to direct the trial court to dispose of Crl.M.P. No.2010 of 2015 as early as possible. In view of the submission made by the learned counsel for the petitioner, this court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the learned I Metropolitan Magistrate, Vijayawada, is hereby directed to dispose of Crl.M.P. No.2010 of 2015 in C.C. No.249 of 2014 as expeditiously as possible, preferably, within a period of two months from the date of receipt of a copy of this order. 4.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions if any pending in this criminal petition shall stand closed.
