This petition is filed to withdraw C.C.No.645 of 2013 from the file of XIV Metropolitan Magistrate at L.B.Nagar, Cyberabad and transfer the same to the Court of Chief Metropolitan Magistrate, Vijayawada.
2. The petitioner is the de facto complainant and she filed this petition. According to her affidavit, her marriage with respondent No.1 was held on 12.02.2012 at Tirupathi. She stated that respondent No.1 and his family members ill-treated and harassed her for additional dowry and finally she was necked out from matrimonial home and having no other alternative she lodged a complaint before Women Police Station, Saroornagar, Hyderabad. She stated that the 1st respondent filed O.P.No.353 of 2012 before Family Court, Hyderabad seeking annulment of marriage with false grounds and that as she felt difficult to appear for each and every adjournment at Hyderabad, she filed C.M.P.No.293 of 2012 for transfer of O.P. from Hyderabad to Vijayawada and the same was allowed. She further stated that respondent No.1 is attending the said O.P. and now she is residing with her parents' at Vijayawada, it difficult for her to travel all the way from Vijayawada to Cyberabad. For these reasons, she prayed for transfer of O.P. from L.B.Nagar, Cyberabad to Vijayawada.
3. Both counsel submitted that they have no objection to transfer the case. Learned counsel appearing on behalf of
MSKJ,J respondents 2 to 4 submitted that during the course of trial, the presence of respondents 2 to 4 may be dispensed with.
4. Considering reasons stated in the affidavit and also considering the request of both the counsel, C.C.No.645 of 2013 is withdrawn from the file of XIV Metropolitan Magistrate at L.B.Nagar, Cyberabad and transferred to the file of the Chief Metropolitan Magistrate, Vijayawada, for disposal in accordance with law. During the course of trial, the presence of respondents 3 and 4, who are the mother-in-law and father-in-law, is dispensed with, unless required for any specific purpose.
5. Accordingly, the Transfer Criminal Petition is allowed. Pending miscellaneous applications, if any, shall stand closed in consequence.
