Respondent/Complainant COMMON ORDER These two Criminal Petitions are filed praying this Court to enlarge the petitioners on bail who are arrayed as accused Nos.4 to 7 in Crime No.76 of 2026 of Maddur Police Station, Narayanpet Police Station. The offences alleged against the petitioners are punishable under Sections 74 of the BNS, Sections 11 and 12 of the POCSO Act, 2012, Section 3 (2)(va), 3 (1)(w)(i) of the SCs/STs (POA) Act.

The case of the prosecution is that on 26.03.2026, the respondent-police received a complaint from Headmaster in ZPHS Mominapur Village, wherein he stated that on 07.03.2026 at about 1330 hours one C.Swamy misbehaved by touching and kissing a female student with a female student and same was recorded in CCTV footage and it has gone viral on social media. Hence, he requested the police to take necessary action on the said complaint. Basing on the same, initially police registered a case under Section 11 of the POCSO Act and during the course of investigation and after recording the statement of the victim, the aforesaid offences were included. The allegation against petitioner Nos.4 to 7 is that a panchayat conducted and in the said panchayat they decided that the accused have to pay an amount of Rs.8,00,000/- knowingly suppressed that minor girl was raped by them, as such, the petitioners were arrayed as Accused Nos.4 to 7.

Heard Dr.Challa Srinivas Reddy, learned counsel appearing for the petitioners and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioners would submit that the petitioners are committed the offences alleged against the
- 3 - petitioners and a false case been foisted against them; that the petitioners have been in judicial custody since 28.03.2026; that material part of the investigation is completed including the statement of L.Ws.1 to 17 were recorded; that the petitioners are ready to cooperate with the investigation and hence, he prays to grant regular bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed for grant of bail contending that the petitioners showing that they are elders of the villagers suppressed commission of offence and the same are equally liable along with A.1 to A.3 and hence, he requested the Court to dismiss the petitions.

Notice served on the victim. The counsel appearing for the victim stated no objection for grant of bail to the petitioners. 7.
Considering the submissions made learned counsel for both parties and the material placed on record, the petitioners have been in judicial custody from 28.03.2026. As seen from the material on record, L.Ws.1 to 17 were already examined including the Investigating Officer and victim. Therefore, considering the allegations against the petitioners and the period of incarceration of petitioners in jail and the facts and
- 4 - circumstances, this Court deems it fit to grant bail to the petitioners subject to the following conditions: i.
The petitioners shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Kosgi, Telangana State. ii.
The petitioners shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 483(2) of the BNSS.
