THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15186 OF 2019 O R D E R :

This writ petition is filed challenging the action of the 3rd respondent in interfering with the civil disputes of the petitioner and in threatening the petitioner to handover possession of his landed property to an extent of 38 guntas in Sy.No.130/A/2/aa of Karkal Pahad, Kadthal Mandal, Ranga Reddy District, at the instance of 4th respondent by calling him and his family members to the police station, every day, under the guise of registration of case in Crime No.4 of 2018 on the file of Kadthal Police Station, Rangareddy District. Learned Assistant Government Pleader for Home basing on the written instructions dt. 22.07.2019, submitted by the Sub-Inspector of Police, Kadthal P.S., Ranga Reddy District, submits that on the complaint of 4th respondent a case in Crime No.

4/2018 was registered under Sections 447, 427, 120(b), 307, 504 and 506, read with 34 IPC on the file of Kadthal Police Station on 04.01.2018, wherein the petitioner is arrayed as Accused No.2; that during the course of investigation the Investigating Officer issued notice under Section 41(A) Cr.P.C. to the petitioner on 27.06.2019 to submit relevant documents in the said case and that the accused has turned up before the Station House Officer, Kadthal Police Staiton. The other allegations regarding interference with the civil disputes and threatening the petitioner to handover the possession of his land were all denied.

In view of the aforesaid written instructions, the writ petition is disposed of directing the respondent police not to interfere with the civil disputes pending between the petitioner and unofficial respondent. However, this order will not preclude the respondent police from investigating into the crime. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
